Please read these Terms carefully before accessing or using AIRS.

01 Introduction and Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Webtek Sdn Bhd (Company Registration No. 202201006226), a company incorporated in Malaysia with its registered address at Puchong, Selangor, Malaysia ("Webtek," "we," "us," or "our").

These Terms govern your access to and use of AIRS (AI Revenue & Reservation System), including all features, tools, dashboards, APIs, integrations, and related services provided by Webtek (collectively, the "Service" or "Platform").

BY REGISTERING FOR, ACCESSING, OR USING AIRS, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree, you must not access or use the Service. If you are agreeing on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
02 Definitions

For the purposes of these Terms, the following definitions apply:

  • "AIRS" or "Platform" means the AI Revenue & Reservation System software-as-a-service product developed and operated by Webtek Sdn Bhd.
  • "Account" means the unique account you create to access and use the Service.
  • "Customer Data" means all data, content, and information submitted by you or your guests through the Platform.
  • "Free Trial" means the complimentary one (1) month access period granted upon registration, subject to Clause 4.
  • "Subscription" means a paid plan selected by the Customer following the Free Trial or at any time during use.
  • "Property" means your hotel, serviced apartment, resort, guesthouse, or other hospitality establishment registered under your Account.
  • "Guest" means any end user who interacts with the AIRS AI assistant on your behalf.
  • "AI Assistant" means the artificial intelligence-powered conversational agent component of the Service that handles guest inquiries and reservation requests.
  • "Dynamic Pricing Engine" means the revenue management module that provides pricing recommendations based on occupancy, demand, and market data.
  • "Confidential Information" means any non-public information disclosed by either party to the other in connection with these Terms.
03 Eligibility and Account Registration
3.1 Eligibility

To use AIRS, you must:

  • Be at least 18 years of age;
  • Be a legally registered business or an authorised representative of a legally registered business;
  • Have the legal capacity to enter into a binding contract under the laws of Malaysia; and
  • Not be prohibited from using the Service under any applicable law or regulation.
3.2 Account Registration

You must register an Account to access AIRS. You agree to provide accurate, current, and complete information during registration, and to update such information to keep it accurate. You are responsible for:

  • Maintaining the confidentiality of your Account credentials;
  • All activities that occur under your Account;
  • Notifying Webtek immediately at contact@webtek.my if you suspect any unauthorised access to your Account.

Webtek reserves the right to refuse registration, suspend, or terminate any Account at its discretion.

04 Free Trial
4.1 Trial Period

Upon successful registration, Webtek grants you a one (1) calendar month free trial of AIRS ("Free Trial"). The Free Trial commences on the date your Account is activated and expires at 23:59 Malaysian time on the last day of the one-month period.

4.2 Trial Scope

During the Free Trial, you will receive access to the full functionality of the Starter plan tier, including:

  • AI Reservation Assistant (up to 30 rooms);
  • WhatsApp and website chat integration;
  • Basic revenue reports;
  • Email support.
4.3 No Credit Card Required

No credit card or payment information is required to activate the Free Trial. At the end of the Free Trial, your Account will automatically revert to a limited free tier unless you subscribe to a paid Subscription plan.

4.4 One Trial Per Property

The Free Trial is limited to one (1) trial per Property and per legal entity. Webtek reserves the right to revoke the Free Trial if it determines that the Customer is attempting to circumvent this limitation by registering multiple Accounts.

05 Subscription Plans and Fees
5.1 Available Plans

Following the Free Trial, continued access to AIRS requires a paid Subscription. The following plans are available (pricing subject to change):

  • Starter Plan — RM399/month: Up to 30 rooms, AI Reservation Assistant, WhatsApp and website integration, basic analytics, email support.
  • Professional Plan — RM799/month: Up to 150 rooms, all Starter features, Dynamic Pricing Engine, competitor rate monitoring, revenue forecasting dashboard, priority support and onboarding.
  • Enterprise Plan — Custom pricing: Unlimited rooms, full platform access, custom AI training, API access, dedicated account manager, SLA guarantee.
5.2 Billing and Payment

All Subscription fees are payable strictly on an upfront basis prior to the commencement of each billing period. Access to the Service will only be activated or renewed upon receipt of full payment. All fees are quoted and payable in Malaysian Ringgit (MYR). Payment is accepted via credit/debit card, online banking (FPX), or such other methods as Webtek may make available. Invoices are issued electronically to the email address registered on your Account. Webtek reserves the right to suspend or withhold access to the Service if payment is not received upfront before the start of a billing period.

5.3 Annual Billing Discount

Customers who elect annual billing receive a 20% discount on the applicable monthly rate. Annual subscriptions are non-refundable except as set out in Clause 5.7.

5.4 Price Changes

Webtek reserves the right to modify Subscription fees at any time at its sole discretion. Subscription fees are subject to change without prior notice, unless otherwise required by applicable law. Webtek will endeavour to notify registered Customers of fee changes via email before the change takes effect. Your continued payment of the revised fee at the next upfront billing cycle constitutes your acceptance of the updated pricing. If you do not agree to the revised fees, you must cancel your Subscription before the next billing date.

5.5 Late Payment

If payment is not received by the due date, Webtek reserves the right to suspend your Account and access to the Service until all outstanding amounts are settled. Webtek may charge interest on overdue amounts at 1.5% per month or the maximum rate permitted by Malaysian law, whichever is lower.

5.6 Taxes

All fees are exclusive of Sales and Service Tax (SST), goods and services tax, or any other applicable taxes. You are responsible for paying all such taxes applicable to your Subscription.

5.7 Refund Policy

Subscription fees are generally non-refundable. Webtek may, at its sole discretion, offer a pro-rata refund in the event of documented technical failure attributable solely to Webtek that renders the Service unavailable for more than seventy-two (72) consecutive hours during a billing period.

06 Permitted Use and Restrictions
6.1 Licence Grant

Subject to these Terms and payment of applicable fees, Webtek grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business operations in connection with your registered Property.

6.2 Acceptable Use

You agree to use AIRS only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to engage in any fraudulent, deceptive, or misleading activity;
  • Misrepresent your identity, property details, or pricing to guests;
  • Use the AI Assistant to generate or transmit spam, unsolicited messages, or communications that violate applicable law;
  • Attempt to reverse-engineer, decompile, disassemble, or derive source code from any part of the Platform;
  • Use the Service in any manner that could damage, disable, overburden, or impair the Platform or its underlying infrastructure;
  • Scrape, crawl, or systematically extract data from the Platform except via authorised API access;
  • Sublicence, resell, or provide the Service to third parties without Webtek's prior written consent;
  • Use the Dynamic Pricing Engine to engage in price gouging or practices prohibited under Malaysian consumer protection laws;
  • Input or transmit content that is unlawful, defamatory, obscene, or infringes any third-party intellectual property rights.
6.3 Responsibility for Guest Interactions

You are solely responsible for all guest interactions facilitated through the AI Assistant on your Account. You acknowledge that the AI Assistant operates on the information and instructions you provide. You must ensure that the information you configure in AIRS (room types, pricing, policies, facilities) is accurate and up to date.

07 AI Features — Limitations and Disclaimer
7.1 Nature of AI Outputs

AIRS uses artificial intelligence and machine learning technologies to generate responses, pricing recommendations, and revenue forecasts. You acknowledge that:

  • AI outputs are generated probabilistically and may not always be accurate, complete, or appropriate;
  • Pricing recommendations from the Dynamic Pricing Engine are advisory in nature and do not constitute guaranteed revenue outcomes;
  • Revenue forecasts are based on available data and general market indicators and should not be treated as financial advice;
  • The AI Assistant may occasionally misinterpret guest queries or provide imprecise responses.
7.2 Human Oversight

You are responsible for reviewing AI-generated pricing recommendations, revenue reports, and guest communications before acting on them. Webtek strongly recommends that you maintain human oversight of all material business decisions made in connection with the Service.

7.3 No Guarantee of Bookings or Revenue

Webtek does not guarantee any specific number of bookings, occupancy rates, or revenue improvements as a result of using AIRS. All performance statistics and projected outcomes referenced in our marketing materials are illustrative and based on general industry benchmarks.

08 Data, Privacy, and Security
8.1 Customer Data Ownership

You retain all ownership rights to your Customer Data. By using the Service, you grant Webtek a limited, non-exclusive licence to process and store Customer Data solely for the purpose of providing the Service to you.

8.2 Privacy Policy

Your use of AIRS is subject to Webtek's Privacy Policy, available at airsystem.my/privacy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and protect personal data in accordance with the Personal Data Protection Act 2010 (Malaysia) ("PDPA").

8.3 Guest Data

You acknowledge that guest personal data (names, phone numbers, email addresses, booking preferences) collected through the AI Assistant is processed by Webtek on your behalf as a data processor. You, as the data controller, are responsible for:

  • Obtaining any necessary consents from your guests for the collection and processing of their personal data;
  • Ensuring your use of guest data complies with all applicable data protection laws;
  • Providing guests with notice of how their data is used.
8.4 Data Security

Webtek implements industry-standard technical and organisational measures to protect Customer Data against unauthorised access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. Webtek cannot guarantee absolute security.

8.5 Data Retention and Deletion

Webtek retains Customer Data for the duration of your Subscription and for a period of ninety (90) days following termination, after which it will be deleted from our active systems. You may request earlier deletion by contacting contact@webtek.my.

09 Intellectual Property
9.1 Webtek Intellectual Property

AIRS, including its software, design, AI models, algorithms, trademarks, logos, and all related documentation, is the exclusive intellectual property of Webtek Sdn Bhd. These Terms do not transfer any ownership rights in the Platform to you. All rights not expressly granted herein are reserved by Webtek.

9.2 Feedback

If you provide Webtek with feedback, suggestions, or ideas regarding the Service, you grant Webtek a royalty-free, worldwide, perpetual licence to use and incorporate such feedback into the Platform without any obligation to you.

10 Confidentiality

Each party agrees to keep the other's Confidential Information confidential and not to disclose it to any third party without prior written consent. This obligation does not apply to information that: (a) is or becomes publicly known through no breach of these Terms; (b) was known to the receiving party prior to disclosure; (c) is independently developed by the receiving party; or (d) is required to be disclosed by law or court order, provided the receiving party gives prompt written notice to the disclosing party where legally permissible.

11 Warranties and Disclaimers
11.1 Webtek Warranty

Webtek warrants that the Service will perform materially in accordance with its documentation during the Subscription period. Your sole remedy for any breach of this warranty is as set out in Clause 5.7.

11.2 Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WEBTEK EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WEBTEK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY MALAYSIAN LAW: (a) WEBTEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF WEBTEK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) WEBTEK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO WEBTEK IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms shall limit or exclude Webtek's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13 Indemnification

You agree to indemnify, defend, and hold harmless Webtek and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your Customer Data or guest data; or (e) any dispute between you and a guest.

14 Term and Termination
14.1 Term

These Terms commence on the date you register your Account and continue until your Account is terminated in accordance with this Clause.

14.2 Termination by Customer

You may cancel your Subscription at any time by providing written notice to contact@webtek.my or through your Account settings. Cancellation takes effect at the end of your current billing period. No refund is due for the remaining period unless otherwise specified in Clause 5.7.

14.3 Termination by Webtek

Webtek may suspend or terminate your Account immediately upon written notice if:

  • You breach any material provision of these Terms and fail to remedy the breach within fourteen (14) days of written notice;
  • You become insolvent, enter liquidation, or make an assignment for the benefit of creditors;
  • Webtek determines, in its sole discretion, that continued access poses a risk to the integrity, security, or reputation of the Platform; or
  • Webtek ceases to offer the Service.
14.4 Effect of Termination

Upon termination: (a) your licence to use the Service ceases immediately; (b) Webtek will retain and then delete Customer Data as described in Clause 8.5; and (c) any outstanding fees become immediately due and payable. Clauses 9, 10, 11, 12, 13, and 17 survive termination.

15 Service Availability

Webtek targets a monthly uptime of 99.5% for the Platform, excluding scheduled maintenance windows (of which Webtek will provide at least 24 hours' advance notice) and events outside Webtek's reasonable control. Uptime statistics are calculated on a per-calendar-month basis. Enterprise plan customers are entitled to a separate Service Level Agreement as agreed in writing.

16 Modifications to the Service and Terms

Webtek reserves the right to modify, update, or discontinue any feature of the Service at any time. Webtek will endeavour to provide reasonable notice of material changes. Continued use of the Service after notification of changes constitutes your acceptance.

Webtek may update these Terms from time to time. The revised Terms will be posted at airsystem.my/terms with an updated Effective Date. If you do not agree with any changes, you must stop using the Service and cancel your Subscription.

17 Governing Law and Dispute Resolution
17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

17.2 Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute amicably through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved by negotiation, it shall be referred to and finally resolved by arbitration in accordance with the Rules of the Asian International Arbitration Centre (AIAC), with the seat of arbitration in Kuala Lumpur, Malaysia. The language of arbitration shall be English.

17.3 Jurisdiction for Injunctive Relief

Notwithstanding Clause 17.2, either party may seek urgent injunctive or other equitable relief from the courts of Malaysia to prevent irreparable harm.

18 General Provisions
18.1 Entire Agreement

These Terms, together with the Privacy Policy and any Order Form or Statement of Work, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

18.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18.3 Waiver

No failure or delay by either party in exercising any right under these Terms shall constitute a waiver of that right.

18.4 Assignment

You may not assign or transfer any rights or obligations under these Terms without Webtek's prior written consent. Webtek may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.

18.5 Force Majeure

Webtek shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, government action, power failure, internet disruption, or failure of third-party service providers.

18.6 Language

These Terms are drafted in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.

18.7 Notices

All legal notices to Webtek under these Terms shall be sent in writing to: Webtek Sdn Bhd, Puchong, Selangor, Malaysia, or by email to contact@webtek.my. Notices to you will be sent to the email address registered on your Account.
